Apple vs. Samsung Case to Be Heard In October by Supreme Court

Following Friday a small legal brief to the Supreme Court of the United States was delivered. Apple requested the Supreme Court to uphold the favorable lawsuit for patent against Samsung. Apple says that till date the Korean company has failed to submit any substantial evidence. Simultaneously Samsung is also requesting to send back the case to the lower court for judgment and formal closure.

Samsung also says that the non-partial judgment in the patent case of Apple vs. Samsung should be made on the basis of the individual components of the smartphones. It should not be measured on the basis of the profits returns. The case between both the companies originated back sometime in 2012. Samsung was charged $1.08 billion by the jury from California for the damages of infringing the software and hardware patents of the Apple.

The appeal for the partial retrial slashed the damages by half and bought it at $548 million. Samsung paid the reimbursement to the Apple last year as the company already exhausted with further legal option. Samsung is trying to dodge the ruling of the court and has filed a petition that the filed damages are excessive. Samsung say that the court cases files in court against the cases of the smart phones or similar complex devices should be judged on the basis of the parts rather the complete device.

If Samsung wins here then there are high chances that the case could be pushed back to the lower court then. The court case will be discussed in the highest court of the nation, The Supreme Court will be judged on Oct. 11. None of the executives from both the company have spoken anything about the court case. If Samsung loses then they will end up losing tons of money against the Apple.
