Court Upholds $450M Settlement In Apple’s e‐books Case, But Supreme Court Appeal Still Waits

John Bradley, a resident of Oklahoma had recent appealed the agreement of $450 million. In the appeal, the questions pertaining to the settlement agreement included its adequacy, reasonableness and fairness. In Federal appeals court decision, the conditional settlement of Apple was upheld.

It is said if the ruling that was original released is upheld, then the company is to pay consumers an amount of $450 million, which covers the legal fees and reimburses the consumers.

The US Supreme Court was asked by the company to overturn the last October’s verdict pertaining to the antitrust e‐book. In 2013, Judge Denise Cote a district Judge handed down the verdict that was taken out initially. The Judge was standing by the Justice Department. It was believed that the company and a few publishers conspired to inflate the prices of e‐books artificially.

The 2nd US Circuit Court, on Wednesday had let out a decision which stood on the same grounds of a lower District Court. As per the decision, John was called a professional objector. Furthermore, it was also said that the way the appeal made was by a person didn’t reflect the way the company’s class member who has a steak would.

In order to launch the bookstore, the book publishers and Apple decided to switch and opt for the Agency pricing model. This means that the prices could be controlled by the publishers. This would help in controlling and preventing resellers such as Amazon from further cutting the rates. The increase prices of the e‐books subsequently led to action being taken from the government.

The agency decided to go back and opt for the wholesale model. This allows resellers like Amazon to sell titles below or at the cost that they set if they wish to do so. This is a model that is preferred by resellers as it provides the necessary flexibility for selling the e‐books.
