Apple has got hit with another lawsuit today. The law suit is about the replacement devices which Apple grants. This is surely not the first time when Apple has been alleged about providing refurbished devices under warranty replacement to the consumers. The latest filed lawsuit filed in California states that, Apple does not hold true in their contract with the consumers. AppleCare+ contract states that the phone replaced under warranty will be as good as and equivalent to a new phone however Apple has been replacing their phones with old refurbished devices. Joanne McRight and Vicky Maldonado and initiated this lawsuit on Apple.
Both of them claimed that they submitted their devices with Apple care and both of them were given old refurbished devices from the Apple care against their new devices. Vicky Maldonado noticed that her replaced device is not working properly. It did not function well as expected after the replacement hence Apple breaks their performance agreement with the consumers here. This is a pure stigma on Apple and their reliability in the market. If Apple loses this case and the allegation is proved then surely Apple will be losing a major chunk of their consumers in the market. Both McRight and Maldonado states that the word refurbished means straight that the device has been reconditioned. It means that an old device has been modified for solving the purpose.
It is not as good as new device. Apple generally gives the option to the consumer for either waiting for their own devices or plainly accepting another device as a replacement against their original devices. Though both the parties were given the option of repair however they accepted the offer of accepting the device and now they are fighting against their refurbished devices.
Apple has breached their contract for replacement devices and this is hence the case of fraud against the company.
