It looks like Apple has hit the legal water again as the company is being Sued by a Florida Man for $10 Billion. Thomas S. Ross, who is a resident of Florida, filed a lawsuit against the company with the claims of the iPod iPad and iPhone is said to infringe his invention that he made in 1992. He claims that he has the original hand drawn figures of the ERD or Electronic Reading Device.
The claims that have been filed in court by the plaintiff first filed a so called device which was aggregated and designed 15 years prior the release of the first iPhone. In 1992, between May 23rd and September 10th, there were three technical drawings which were hand drawn by Ross of the device. In his diagrams, it can be seen that there is a rectangular flat panel with corners that are round and various kinds of functions that is attached to the device.
In November 1992, he had filed his invention through an application made for utility patent, however in April 1995, due to the fact that the required fees had not been paid by him, the US Patent and Trademark Office had declared that the application was abandoned. In 2014m he also went ahead to and filed his technical drawings for the copyrights with the U.S. Copyright Office.
The claims that the plaintiff has made is that due to this experience, he has faced irreparable and great injury which can’t be measured or compensated in money. In his demand, he has also asked for a jury trial as well as the restitution that in terms of the sales that Apple makes worldwide n the infringing devices, he wants a royalty of around 1.5% and $10 billion. The case number that has been allotted which was filed between Ross v. Apple, Inc is said to be 0:2016cv61471 and is with the Florida Southern District Court.
