It seems to be that the patent battle is something that is never ending; an amicus brief was filed by the Department of Justice in regards to the case that is ongoing between Samsung and Apple. It was announced back in December that Samsung and Apple had reached a settlement of $548 million, however the Supreme Court was asked by Samsung shortly after that to hear its case appeal/ they also stated that the design patent law was misapplied by the lower court.
Apple put across their point of argument stating that the case was already closed and had requested the Supreme Court not to give in the appeal of a hearing. In March, however, it was decided by the Supreme Court to go ahead and listen to what Samsung had to say in regards to the case.
According to Reuters, it is believed that now an amicus brief has been issued by the Department of Justice on Samsung‘s behalf about the overturning of the court ruling that was in favor of Apple. It has also been said that the case will be sent back to the trial court. The Department of Justice also specifically said it is not clear if there was enough evidence provided by Samsung so that their argument could be supported. This was in regards to the components of the phone and not the complete phone, but the main concern here is how the damages will be calculated.
This is one of the reasons that it was also suggested by the DOJ that the case should be sent back by the Supreme Court to the trial court so that it can be determined of a new trial should start based on the issue in question. The case that has been going on between Samsung and Apple goes back around 5 years. At that time, Samsung had been ordered originally to pay Apple $1 billion in regards to the violation of the design patent of iPhone during the time they designed the Galaxy range, ever since then, there have been various times where the ruling has been pulled apart.
