A case has been lodged at the Court in Paris against Apple, by the France’s Directorate General for Competition, Consumer Affairs and Fraud Control. BFM.TV’s report was the first to bring this out in the open. The reason behind the case being lodged is because of the claims made that the 4.85 million Euros is what the company owes. The complaint was made pertaining to certain contract clauses that the company has with the country’s mobile operator. Being a body which is under the French Finance Ministry, the DGCCRF have made claims that the company the company has a lot of grip over the mobile carriers.
There have 10 clauses in the contract that has been made by the company which is opposed by the DGCCRF. The clauses relate to certain conditions that Apple has put about the number of products that has to be ordered, the kind of advertisement required, the different mobile plans and other such guidelines that has been set by the company which has to be followed by the carriers if they wish to start selling iPhones.
Other things that were also mentioned in the clauses made included the permission given to the Apple for using the patents the carriers held, the various requirements for the carriers so that the costs of repairs and iPhone displays in the stores are covered. It is also somewhere mentioned that the company is not required to adhere to the guidelines that are mentioned in the contract which was made by the company.
When looking at the breakup of the fine amount that the DGCCRF has put against apple, it includes SRF’s €14 million, Orange’s €11.6 million, Bouygues Telecom’s€6.7 million and Free Mobile’s $8.2.There are also fines that have amounted to €8 million that also has to be paid by the company.
