For a very long time now, Samsung and Apple are facing battles against each other in courts with reference to various patents. The endless fight took some very interesting turns this last week. As per the reports, Apple had stated that the court rule which was stated most recently, had actually violated the “right to trial by jury”, which is in fact the 7th Amendment of the United States Constitution. Earlier, during a patent battle in the year 2014, Apple had been offered a sum of $119.6 million when Samsung had been found guilty of violating three out of the five patents which were held in dispute.
As a final result of the 2014 ruling, all of it was overturned and the money not awarded to Apple. This last month, appeals in the court stated that Samsung had not infringed one out of the three patents they had been charged with. Moreover, the other two patents were made invalid, finally resulting in the dissolving of the award. As per the reports published by Reuters, the appellate of the court not only referred to the records made on the trial court, but had also provided with new evidence proving the facts in favor of Samsung.
To this, Apple had actually provided with a valid arguments. As per Apple’s arguments, only a judge has the right to overturn a judgment, that to only is the overturn is based on lawful terms. On the other hand, no one has the power to overturn the decision by considering a completely new evidence which had initially not been posted when the case was originally running in the court. As per the regular trend of such cases where these two companies are involved, the case will finally land up in the hands of the Supreme Court.
