Supreme Court Agreed to Hear Samsung’s Appeal Over Apple’s Charter

Earlier in March, the Supreme Court agreed to hear Samsung’s appeal on the ongoing design charter cold war with Apple. While Apple had encouraged the Supreme Court not to take up the case, stating, Samsung “had its day in court,” the official website of the court published some day’s ago, that they will hear the case on 11th October. The Supreme Court had at first declared its decision of hearing the suit in March, but the date remained unknown until the announcement on the court website.

Samsung’s claim

The hearing will be based on two licenses that Apple has guaranteed Samsung encroached upon. The verbose fight apparently ended in December, when it was reported that Apple and Samsung had come to a $548 million settlement. This settlement had a loophole, in any case: Samsung declared in its part of the understanding that they enjoy all authority to recover repayment if any part of the trial is modified. This is the exact thing that it did when it asked the Supreme Court to hear the case.

Samsung further claimed that the lower courts twisted the law pertaining to Apple’s design licenses in two different ways. Initially, Samsung stated that the judge neglected to “legitimately train the jury on the distinction amongst useful and decorative elements.” Secondly, the organization contends that damages granted on them were too much.

Position of Apple

A month ago, the United States Department of Justice documented an amicus outline for the benefit of Samsung. As stated by the DOJ, the Supreme Court needs to turn over the ruling of the appeal court that was in favour of Apple and request trial court to take up the case. While $548 million from Samsung has been already sent to Apple, the result from the Supreme Court hearing could see Apple repaying Samsung for some portion or the whole of the settlement.

Final outcome

The Samsung vs. Apple hearing was scheduled for the first part of the day on 11th October. Many social and print media platforms will be there to cover the whole hearing and let layman know about the final outcome. Meanwhile, everyone needs to watch out if this five year long war will come to end officially.
